I cant tell from the pictures if you are using the pennies to make the level *level* or if there are peaks and valleys under the level itself.

Your floor needs to be *flat* but not necessarily *level*. If you put the level down on the floor (no pennies), can you see light peering through in spots under the level? If so, thats what you might be able to complain about.

Its also possible that the contractor did in fact flatten out your subfloor, but didnt install the tiles flat to each other.
