quartz countertop question

I know, this isn't a tile question.

I just got a quartz countertop installed in my kitchen. Some of the top is smooth and some of it feels rough, like it has some glue on it. And, when you look at it at an angle you see like a haze or mottledness on it. What is causing this look/feel on it. Is there some kind of substance still on it? Or does it need to be polished more?

You can't see it with a photo CX, you feel it with your hands...but if you insist.

Has to be really low light.

Anyway, it was a terrible install. So I don't care anymore.
Fabricator/installer said:

1. Don't use soap on it
2. Don't use a sponge on it
3. Has to be sealed every year.

All that is wrong because it's quartz.
I've given him until Monday, Oct 10, 2022 to give me a refund and take it out. If he doesn't I'm taking him to Small Claims court.
Install problems:

1. The over hangs on the main counter weren't the same. Once he got them even the countertop is wopperjawed (Indiana term). From the wall to the edge the depth is 24.5" to 25"
2. On the countertop which has the gas cooktop, the countertop is too deep, it sticks out par the door fame 3/8". My old countertop was even or a little shy of the doorframe. The depth means the overhangs aren't even.
3. He seamed it for the "L" part. Why, I don't know.
4. AND, I'm not sealing quartz every year!

I haven't heard from him and I don't expect to see him on Monday so I'm getting my stuff ready for Small Claims court.

Documentation is the key to Small Claims Court, just as with any legal proceeding, Pat. I've used such courts only in Texas, but here you have no standing until you have a loss, which does not appear to be your case yet.

If you proceed right now, I expect the first thing the court will wanna know is whether you have presented your problems to the contractor and given him an opportunity to correct the conditions in dispute. The court may or may not consider your requirement that he tear out the installation and give you a refund as qualifying as such an opportunity, and such opportunity seems to apply in most states, best I can tell. And requiring him to comply with anything on a national holiday is also likely to be an issue.

If you can show that you have clearly identifiable installation errors or omissions, and can show that the contractor has refused to correct them within a reasonable time, you're likely within your legal bounds to have another contractor tear out and replace the tops and claim all the real costs of having that done, so long as such costs are within the maximum limits for such courts in your state, of course.

But even if the court finds in your favor and requires that the original contractor pay your claimed expense, there is still the very real issue of actually making him pay. I've found that substantiating a claim and prevailing in Small Claims Court is fairly simple and straight forward, while actually getting paid may be a good deal more complicated and difficult.

My opinion; worth price charged.

No lawyer here, Kevin. And that's one of the very best parts of Small Claims Court, at least in Texas; no lawyers allowed! If you bring one, she can sit outside the room and you can keep pissing off the "judge" by going out to axe her questions, but best not to do that.

Well, I am taking the guy to small claims court. I've filed already and we've been to court 2 times already. We have the final trial on March 17th, then you get the judge's ruling about 2 weeks later. I have tons of pictures and can show he didn't install the material I asked for. And invoices and receipts from paying th other company.

I've already had it taken out and other new countertops put in by another company. Much better install and waaaaaay faster. 1st guy/company was at my house from like 9:30 am to 3:15 pm . 2nd company arrived at 2:00 pm and left at 3:15 pm.
I'm storing the other stuff outside under a tarp.

Also, in Indiana you can have a lawyer in Small Claims court.
