That is crazy,up to 5 years in prison is a bit much for steeling a dang soda. That will probably cost the FL. taxpers a couple hundred thousand.

If you think about it, it should be a felony to sell Coca-cola to another human being. Battery acid is considered a healthier option.

And he prolly' coulda' had a V8 instead.

Wow, I have to admit I was guilty of doing that in my younger years. But this is crazy! But now I see why he got in so much trouble. It all started when he refused to pay when he got caught.

From what you see at the end of the article, the felony charge had to do with previous misdemeanor theft convictions.

Here in California there is penal code section 666. It used to say that if one had a previous convictions for certain theft sections AND had served time in jail for one of them, any future theft could be charged as a felony. It has changed and there must be a certain number/type of convictions for theft AND some time served in jail.

The way it works out, these guys usually had a long history of theft convictions before they ever got assigned jail time. After this, they would be told that, if convicted again, it could be a felony. So for this to be charged as a felony, the suspect usually has a long history of theft, and they keep on stealing.

So the felony charge is likely for not stealing the Coke, but the fact that his past is catching up with him.

Looks like he is a chronic Jerk. 5 years for a coke might learn him something, but I doubt it.

This is the type guy who will end up with an institutionalized mentality...let him out and he will end up back in prison where he is more comfortable.

He stays in the usa because Mexican prisons dont have the good chow, free dental care and Internet sex for the inmates!!!

I don't think stealing the soda was the issue, he has a record and refused to pay when asked. Seems like a guy who has had his shot at fair chances and can seem to straighten himself out.

If he couldn't afford the $2 soda, drinking clean water should be enough for him.

Previous theft convictions and being asked to pay refusing, being asked to leave, getting belligerent, sounds like a guy that feels entitled to take what he hasn't earned and do what he feels like doing without regard for other peoples rights.

Only thing that saddens me about the story is the fact that taxpayers have to now pay for his living expenses, as well as their own sodas.
