They both aren't necessarily to blame. We need to find out who supplied the material.

If the homeowner supplied it, it rests on their shoulders. Now I know what just about everyong is going to say. You wanna say that the professional should have brought it to the attention of the homeowner before installing. That would indeed be the best thing to do. But y'all are saying that because most of the pros on this forum are more conscientious than the average installer. There's a difference between should and shall. If the homeowner supplied the material, they don't have a lot of legal ground to stand on here.

I'm still anxious to see how Dave answers the questions in post #6.
