Greetings all. Juggling my chemo sessions in between work has been difficult. The position in San Antonio fell through, but it seems as if the man upstairs has other plans for me.

I moved out of the current apartment complex after completing a 12 month lease at what I thought was a reasonable rate for Dallas for a 2 bedroom/2 bathroom apartment ($1,040 including $10/month pet rent). When I notified them that I would be moving at the beginning of November (lease expired 31 Oct), all the manager could say was that I was required to give 60 days notice of intent to move out, even though I was month to month. They didn't want to hear that month to month means 30 days and not 60. I contacted an attorney friend who reviewed my contract and the letter I sent in response to the manager's offer, which increased my rent to $1,425/month. While he wasn't too happy with my use of the word 'extortion', he told me that I should move out at the end of November as planned, and that he would go after the complex if they kept my security deposit as 'liquidated damages'.

I got to thinking a week or so ago that our family friend, Clint Hundley, who passed away in September, had a house that I assumed was still vacant. After talking with his brother first and his dad a couple of days later, I am planning on moving into his house for a minimum of three months at $800/month. After three months, I will either move out or will sign a year lease at $1,250/month for a 3 bedroom, 2 bath house with a large yard and a two car garage (1,500 sq ft). I believe that I'll get the keys on Monday, 22 Dec, so I'll be in before Christmas. I'm leaving most of my belongings in storage until I know for sure whether or not I'll be staying at Clint's house.

I'm currently in an extended stay "Studio 6'...until 22 Dec...and will be moving to another location about 10 miles away. The manager at the current location wants me to either take my boxer, Boomer, with me when I leave or put him in a kennel when I'm not in the apartment...this is a dog who doesn't bark much, and who likes most people. Who knows...

Good luck Scott, hang in there, i just moved four times in three years,when i was a kid one year i moved 11 times. :bow:

Good luck Scott. We moved over the summer after being in one place for 16 years. The moving part wasn't all that fun, but we really love the new place. :)

Yeah, hang in there Scott, I'm moving to Phoenix from Indianapolis. 1st time I've moved in 22 years. Like Marge said....things do happen for a reason.

Got an early Christmas present...or three the other day. I'll be getting the keys to the new place either Monday or Tuesday, a week earlier than I thought. I dropped by on Saturday to have the first peek at the house. I knew Clint put a deck out back, and his dad mentioned that it was 'good size'. Good size doesn't cut it...it is humongous! Two tiny spots of grass on the backyard and a decent front and side yard. I also bought a leather headboard/footboard and a large teak dining table that comes with either four or six additional leaves, and six chairs. Best thing is I don't have to move the bed or the table, as they are staying put right where they are.

Morning folks...Boomer and I spent about two hours at the new place so he could investigate his new home before I left to head into work. If it warms up this weekend, I'll have a beer outside on the deck in memory of Clint...too darn cold when the temperature is colder than an ice cold beer. Will be moving a few items of furniture in this weekend, but don't plan on doing much heavy lifting this time around.

Greetings all. Really enjoying the new place...having left most everything in storage, I'm taking my time and not toting too much stuff here before I get the earlier boxes unpacked. I'll post a few pictures soon...soon as I find where my camera went. It sure is nice to have a house and a yard to myownself, and not having to worry about no bowdarkskull hotel managers.

Here's a picture of Boomer on the deck...I believe it's the first time he's managed to sit still since we've been here and he's not been sleeping. I'll post more when I can figure out how to compress the pictures from 10.2 MP to something less than 50k.

Looks like I may very well have the last laugh about my deposit. Seems the attorney working with my father in a suit against his former employer says I have a valid deceptive trade practices act complaint against the manager of the complex. Apparently there's a paragraph or two that requires the landlord to give the tenant notice a minimum of 5 days and a maximum of 90 days notice that the 'advance notice of move-out date' is 65-95 days away. Since they failed to do that and only advised me of the increased month to month rent 30 days in advance, they breached their contract with me.

Initially, the attorney is just asking for a return of my $900 deposit within 30 days, to refrain from further collection attempts (no collection agency or reporting to credit bureaus either), or he'll file suit within 60 days claiming three times the deposit amount, storage fees, truck rental fees and the several hundred I spent on temporary lodging until the new place opened...oh, and attorney's fees too.

I do hope they'll just drop it and return my money, but I have a sneaky suspicion they'll decide to fight it. If they return my money, he's considering it pro bono...if they decide otherwise, they're not going to like his $375/hr charge.
